ICLARS Conference: “Freedom of/for/from/in Religion: Differing Dimensions of a Common Right?” (Oxford, Sept. 8-11)

The International Consortium for Law and Religion Studies has announced the Fourth ICLARS Conference, to take place in Oxford from September 8-11, 2016. The theme is “Freedom of/for/from/in Religion: Differing Dimensions of a Common Right?” ICLARS has also issued a call for papers:

CONCEPT
Freedom of religion or belief (FoRB), once considered to be the “first” freedom, has ICLARSbecome a controversial right. In particular, the practical possibility of implementing FoRB in impartial ways are increasingly questioned. Critics argue that FoRB cannot deliver what it promises: an equal share of freedom for people of different or no religion. Further, it is claimed that the right of FoRB, as it is regulated in international and constitutional law, is intrinsically biased because it reflects its Western and Christian origins.

Part of the problem is due to the fact that FoRB is a complex notion, including different dimensions that require careful consideration. Freedom of religion or belief, as a right recognized for every human being, is the first dimension, but not the only one. Freedom from religion, that is the right to live one’s life without being compelled to perform religious acts, is another and freedom for religion, which concerns the institutional side of this right (what was once called “libertas ecclesiae”) is a third dimension that demands consideration. Finally, freedom in religion concerns the rights that the faithful (and sometimes not so faithful) are entitled to enjoy within their religious communities.

These four dimensions of FoRB are the focus of the fourth conference of the International Consortium for Law and Religion Studies. A plenary session will be devoted to each of them and a number of parallel sessions will explore the implications of these four dimensions (see the attached provisional program). A session devoted to young scholars will help launch the conference and two final sessions addressed by representatives of law and religion centers and journals will complete the program.

CALL FOR PAPERS
Scholars are invited to submit papers for the conference, sending an abstract of no more than 300 words, in English, to cristiana.cianitto@unimi.it by March 31, 2016. A separate session is reserved for young scholars (35 years or younger) who may apply for a contribution to cover travel and accommodation expenses.

Dispatches From Kabul: Walls of Separation and the Call to Prayer

In New York it was the sirens that nettled, piercing through triple-paned glass seventeen stories above the avenue at all hours of the day and night. In Kabul it’s the call to prayer that distracts, albeit less frequently, and which I wake to most mornings. There’s the initial crackle of the loudspeaker, a clearing of the throat, and then a momentary struggle to find the right pitch. The opening words of the azan ring out clearly and confidently – Allahu Akbar – but sometimes, part of the way through, the voice wavers and there is an awkward adjustment of the register, an interruption that could be obviated with the initial use of a pitch pipe or the playing of a middle C, I’ve thought. Then again, I’ve never seen a pitch pipe in Afghanistan, and I suppose it would be difficult to put a piano in a minaret.

Since September, we’ve had a string of mediocre muezzins, criers who never fail to rouse us from our sleep just before dawn, but whose recitations of the takbir and shahada – the Muslim Statement of Faith – leave much to be desired. It’s a bit ironic that they’ve been so lacking, considering that muezzins are traditionally chosen for their superior vocal skills. The first, Bilal ibn Rabah, was supposedly plucked from obscurity by the Prophet Mohammad for his beautiful voice. The idea was that the more melodious and clear the expression, the more powerful the azan, and therefore the more compelling would be the spiritual ideology of Islam sung in those eight verses. Allahu Akbar (four times) / I acknowledge that there is no deity but God (twice) / I acknowledge that Mohammad is the Messenger of Allah (twice) / Hasten to Prayer (twice) / Hasten to success (twice) / Prayer is better than sleep (twice) / Allah is greatest (twice) / There is no deity but God (once). This standard of qualification seems not to be taken seriously in my Kabul neighborhood. Perhaps the benchmark here is pünktlichkeit, in which case I’ve no doubt that our muezzins would be considered rousing successes. It’s disappointing, though, that their rendition of the azan does not resonate across the land as an otherworldly call to the divine.

To make matters worse, our current prayer leader has taken to conversing with himself over the loudspeaker after the initial recitation. The intonation is thoughtful, even philosophical, as if he is contemplating deep and important questions out loud. One morning, as I was lying in bed listening to his slow, punctuated words, I started thinking about America and Constitutional law and Jefferson’s letter to the Danbury Baptists. I contemplate with sovereign reverence that act of the whole American people which declared that their legislature should make no law respecting an establishment of religion, or prohibiting the free exercise thereof, thus building a wall of separation between church and state. That wall was adopted by the Supreme Court, becoming authoritative in Reynolds and “high and impregnable” in Everson. In context, Jefferson’s pithy metaphor concerned his opposition to an established national church rather than a belief in strict separationism, but it is a comforting metaphor at dawn while being sermonized over a loudspeaker. In such moments, prayer is not better than sleep.

Jefferis, “Hamas”

Mahler, “Politics and Government in Israel”

 

This month, Rowman & Littlefield releases “Politics and Government in Israel: The Maturation of a Modern State,” by Gregory S. Mahler (Earlham College).  The publisher’s description follows:

Tushnet Participates in Colloquium

Our guest in our law and religion colloquium this week was Harvard’s Mark Tushnet (above), who presented a provocative paper opposing religious accommodations because of the harm they do to religious believers. As Marc points out over at Mirror of Justice (Why are so many law and religion scholars named Mark, by the way? Can it be a mere coincidence?), last month we hosted Princeton’s Robert George, who has a rather different point of view on the question. A powerful, one-two punch!

Nolt, “The Amish”

This month, Johns Hopkins University Press releases “The Amish” by Steven M. Nolt ( Elizabethtown College). The publisher’s description follows:

Zerai, “Intersectionality in Intentional Communities: The Struggle for Inclusivity in Multicultural U.S. Protestant Congregations”

In May, Rowman & Little field will release “Intersectionality in Intentional Communities: The Struggle for Inclusivity in Multicultural U.S. Protestant Congregations” by Assata Zerai (University of Illinois at Urbana-Champaign). The publisher’s description follows:

Over a decade of qualitative research, Assata Zerai has observed both rowmanlittlefieldincremental moves toward inclusiveness and strategies employed to accomplish long-term changes while conducting case studies of five multicultural Protestant churches in sites across the United States. With an interpretive approach, she explores these centers of worship and theorizes the conditions under which progressive social change occurs in some U.S. Protestant congregations. Understanding the daily practices of change and entrenchment in Protestant congregations and the intentional work to replace dominating structures with liberating ones may provide keys to creating multicultural, antiracist, feminist, and sexually inclusive volitional communities more broadly. Intersectionality in Intentional Communities argues that making a significant advance toward inclusion requires change in the underlying social structures of racism, sexism, heteronormativity, class, and other marginalizing influences. In order to isolate this phenomenon, Zerai conducted fieldwork and archival research among an African American and four multiracial U.S. churches. Different from a university or other public institution in which members are legally required to support diversity and related values, Zerai believes that volitional communities may provide a best-case scenario for how, motivated by higher ideals, members may find ways to create inclusive communities. Zerai’s research has a broad empirical base, encompassing five sites: a largely African American urban megachurch in the Midwest; a large Midwestern multiracial/multicultural church; a large urban multiracial/multicultural church in the eastern United States; a small, suburban Midwestern multiracial church; and an inclusive Midwestern college town church. In this book, Zerai further explores important connections between U.S. Protestant Christian congregations and political activism.

Freas, “Muslim-Christian Relations in Late-Ottoman Palestine”

Last month, Springer released “Muslim-Christian Relations in Late-Ottoman Palestine: Where Nationalism and Religion Intersect,” by Erik Freas (Manhattan Community College, CUNY). The publisher’s description follows:

Numerous factors underlie the dynamic shaping of present day Muslim-Christian Arab relations as well as the formulation of Arab national identity.
