Here are some important law-and-religion news stories from around the web:

  • Last year, the U.S. Supreme Court held in 303 Creative LLC v. Elenis that the First Amendment prohibits Colorado from requiring a wedding website designer to design websites for same-sex weddings in violation of her religious beliefs. On remand, 303 Creative LLC v. Elenis, the District of Colorado entered a final order in the case in favor of the designer.
  • The Department of Justice filed suit in federal court seeking to enjoin the California Department of Corrections from requiring Muslim and Sikh officers to be clean shaven so that they can properly wear tight-fitting respirators. The complaint argues that wearing a beard is a sincerely held religious belief and that the Department of Corrections has not made an effort to accommodate the officers by, for example, placing them in positions that do not require use of respirators or offering alternative respirators that fit over beards. 
  • In St. Timothy’s Episcopal Church v. City of Brookings, a federal district court held that a zoning ordinance limiting the number of days a church can serve free meals to needy people violates RLUIPA. The church has been serving meals three to four times per week, but, in 2021, the city amended its zoning code to require a permit to continue serving meals and limited the service to two times per week.
  • In Shlomo Hyman v. Rosenbaum Yeshiva of North Jersey, the New Jersey Supreme Court heard oral arguments in a suit brought by a rabbi who was terminated by an Orthodox Jewish day school for allegedly engaging in inappropriate conduct with elementary school-aged female students. The rabbi alleged the investigation that led to his termination was a “sham” and that he had been defamed, while the day school argued that he could not sue the school because its decision to terminate him is covered under the ministerial exception.
  • In T.I. v. R.I., a New York state trial court held that it would recognize a couple’s religious marriage even though the marriage was later annulled by a religious tribunal. The husband claimed that after the annulment, the marriage no longer existed and sought to have the wife’s civil divorce action dismissed, but the court refused to do so.
  • In S.E. v. Edelstein, an Ohio state appellate court affirmed dismissal of a suit brought by an Orthodox Jewish wife alleging her father-in-law intentionally interfered with a Jewish-law marriage contract she had with her husband. The court found that the suit, although couched as an intentional interference with contract claim, essentially sought damages for alienation of affections and breach of promise to marry, and those claims were barred by Ohio law

  • A petition for certiorari has been filed with the U.S. Supreme Court in Groff v. DeJoy. In the case, the Third Circuit held that accommodating a Sunday sabbath observer by allowing him not to report for work on Sunday would cause an “undue hardship” to the U.S. Postal Service. Therefore, the court held that failure to grant the requested accommodation did not violate Title VII. 
  • In In the Interest of C.C., the Georgia Supreme Court gave guidance to a juvenile court on how to determine whether parents’ objections to vaccinating their children are based on a sincerely held religious belief. The court said in part: “Ultimately, the juvenile court must determine whether the Chandlers’ religious objection to the vaccination of their children is ‘truly held.’ The court should ‘sh[y] away from attempting to gauge how central a sincerely held belief is to the believer’s religion.’ And it must bear in mind that ‘a belief can be both secular and religious. The categories are not mutually exclusive.’ “
  • In Toor v. Berger, the D.C. federal district court refused to grant a preliminary injunction to three Sikh Marine recruits who wanted to prevent enforcement of the Marine’s uniform and grooming policies during recruit training while their case continues to be litigated. Plaintiffs argue that denying accommodation of their religious practices violates RFRA, the Free Exercise Clause, and the Equal Protection Clause. The court held that even if plaintiffs have shown a likelihood of success on the merits and irreparable injury, the balance of equities and the overall public interest favors the military at this preliminary stage of proceedings. 
  • In Bey v. Sirius-El, a New York federal district court dismissed a suit seeking damages, injunctive relief, and criminal prosecution of defendants for barring plaintiff from attending the Brooklyn Moorish Science Temple in person. Plaintiff was barred because of the potential for a conflict between her and a “competing love interest” who has also been attending services. The court dismissed plaintiff’s free exercise claims because she did not allege that any state action was involved. 
  • In Chabad of Prospect, Inc. v. Louisville Metro Board of Zoning Adjustment, a Kentucky federal district court dismissed a suit brought against zoning officials by a synagogue that was denied a conditional use permit to use a home it purchased for religious services. When the property was put up for sale, zoning rules allowed its use for religious purposes. However, before plaintiff purchased the property, the city removed that provision and required a conditional use permit. The court held that plaintiff’s § 1983 claim alleging First Amendment violations was barred by the statute of limitations. Additionally, the court held that plaintiff failed to state a claim under RLUIPA. 
  • In Miller v. Austin, a Wyoming federal district court dismissed on standing and ripeness grounds a suit by two Air Force sergeants who face discharge because of their refusal on religious grounds to receive the COVID vaccine. 

“Young Sikhs in a Global World: Negotiating Traditions, Identities and Authorities” (Jacobsen & Myrvold, eds.)

In August, Ashgate Publishing will release “Young Sikhs in a Global World: Negotiating Traditions, Identities and Authorities” edited by Knut A. Jacobsen (University of Bergen, Norway) and Kristina Myrvold (Linnaeus University, Sweden). The publisher’s description follows:

In attempting to carve out a place for themselves in local and global contexts, young Sikhs mobilize efforts to construct, choose, and emphasize different aspects of religious and cultural identification depending on their social setting and context. Young Sikhs in a Global World presents current research on young Sikhs with multicultural and transnational life-styles and considers how they interpret, shape and negotiate religious identities, traditions, and authority on an individual and collective level.

With a particular focus on the experiences of second generation Sikhs as they interact with various people in different social fields and cultural contexts, the book is constructed around three parts: ‘family and home’, ‘public display and gender’, and ‘reflexivity and translations’. New scholarly voices and established academics present qualitative research and ethnographic fieldwork and analyse how young Sikhs try to solve social, intellectual and psychological tensions between the family and the expectations of the majority society, between Punjabi culture and religious values.
